Terms and Conditions

General Terms and Conditions (T&C) for à-la-carte service at Staigers Waldhorn
Staiger – Gastronomie GmbH, 73207 Plochingen (as of: spring 2026)

This is a convenience translation. In case of discrepancies, the German version shall prevail.

1. Scope
1.1
These General Terms and Conditions apply to all reservations, catering contracts and gastronomic services in the regular à-la-carte operation of Staiger – Gastronomie GmbH, in particular at the restaurant Staigers Waldhorn.
1.2
Separate General Terms and Conditions apply to events, celebrations, private functions, banquets, catering and special events. These form part of the respective offer and contract documents and take precedence over these T&C.

2. Contracting party / conclusion of contract
2.1
The contracting party is Staiger – Gastronomie GmbH. The contracting party of the contractor is the person who makes the reservation, even if it is made for further persons.
2.2
A legally binding catering contract is concluded with a table reservation – regardless of whether it is made by telephone, in person, by e-mail or via online reservation systems.
2.3
A separate written contract is not required for this.

3. Services and obligations
3.1
The contractor undertakes to provide the ordered gastronomic services properly within the scope of operational possibilities.
3.2
The guest undertakes to make use of the reserved places and the services offered to the agreed extent.

4. Prices and billing
4.1
All prices are final prices in euros (€) including the applicable statutory value-added tax.
4.2
Billing is based on the services actually used.

5. Reservations, no-show
5.1
Reservations are binding. If a reservation cannot be kept, we kindly ask for timely cancellation.
5.2
In the case of a non-attended or reduced table reservation in the à-la-carte area, the contractor is entitled to charge a flat-rate loss of earnings of €25.00 per no-show person, provided that no timely notice was given.

6. Number of persons
6.1
The number of persons stated at the time of reservation serves as an organisational basis.
6.2
Downward deviations are considered partial non-fulfilment of the catering contract and may be charged in accordance with § 5.2.
6.3
For reservations of more than 10 persons, we reserve the right, for organisational reasons, to put together a small, reduced selection from our valid menu. This can also be arranged according to your individual wishes.

7. Room rental
7.1 For your reservation we will, where possible, provide the desired place.
7.2 If you wish to use one of our rooms exclusively for your reservation and we agree to this, no chargeable room costs generally apply.
7.3 If exclusive room use is agreed by us, the following room rentals are due in addition to the turnover generated, depending on the day of the event:
Postzimmer: from €200.00
Albvereinszimmer: from €250.00
Waldhorn hall: from €500.00
Stadl: winter €250 / summer €500
The room rental includes normal electricity costs, heating, final cleaning and provision of the premises. Once the minimum turnover defined by us for each room on the day of the event (per the T&C of our separate event planners) is reached, the room rental is waived.

8. Business hours
8.1 Our general business hours are binding for your reservation.
8.2 Services of Staiger Gastronomie GmbH that go beyond the general business hours must be agreed upon at the conclusion of the contract and are generally subject to a charge.
8.3 Our current business hours are:
Monday + Tuesday: 11:00–14:00 and 17:00–22:00
Wednesday is our closing day
Thursday + Friday: 11:00–14:00 and 17:00–22:00
Saturday: 11:00–22:00
Sundays/public holidays: 11:00–20:30
Kitchen closing and last orders are always 30 minutes before the end of business hours.
8.4 If services are provided by our staff beyond business hours, a charge of €35.00 per employee / commenced working hour generally applies.

9. Fire safety and regulations
9.1
For fire safety reasons, the burning of sparklers, fireworks or open fire is prohibited in all premises.
9.2
Decorations or objects brought along must not obstruct escape routes, emergency exits or safety equipment.
9.3
For safety reasons, the instructions of the staff must be followed.

10. Food and drinks brought along / corkage
10.1
Bringing your own food and drinks is generally not permitted.
10.2
Exceptions require prior approval. In this case, a corkage or cover charge may be levied.

11. Cleaning effort
In the case of heavy soiling that goes beyond the usual cleaning effort, the contractor reserves the right to charge an additional cleaning fee.

12. Payment terms
12.1
Invoices are due immediately and are to be settled on site or – if invoiced – within 14 days.
12.2
In the event of late payment, the statutory default interest pursuant to § 288 BGB (German Civil Code) applies.

13. Night surcharge
From 24:00, in addition to the staff costs listed above, a night surcharge of €35 per employee / hour is to be paid.

14. Off-premises services
Separate conditions and event planners apply to off-premises events and catering. These services are not part of these T&C.

15. Place of jurisdiction / severability clause
15.1
The law of the Federal Republic of Germany applies.
15.2
The place of jurisdiction is – as far as legally permissible – Esslingen.
15.3
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
